What Is a Pour-Over Will?

A pour-over will is a will commonly used together with a revocable living trust. Its primary purpose is to direct assets that remain in the deceased person’s probate estate into the trust so they can ultimately be administered under the trust’s terms.

It is best understood as a backup component of a trust-based estate plan. The goal is still to coordinate and fund the living trust during life, but the pour-over will provides instructions for assets that were not properly transferred to the trust before death.

Why a Living Trust Still Needs a Will

Even a carefully prepared trust does not automatically control every asset a person owns. Property may be acquired after the trust is created, an account may remain individually titled, or an asset may be overlooked during the funding process.

A pour-over will helps create consistency by directing probate assets toward the trust rather than establishing an entirely separate distribution plan.

A Pour-Over Will May Also Address Other Important Issues

  • Nomination of an executor to administer the probate estate.
  • Nomination of guardians for minor children.
  • Instructions concerning property that must pass through the probate estate before reaching the trust.
  • Coordination with the beneficiaries and distribution provisions already contained in the trust.

Keeping the Trust and Will Coordinated

The living trust, pour-over will, powers of attorney, health care directive, beneficiary designations, and asset titling should all be reviewed as a coordinated plan. A mismatch between those documents can create unnecessary expense, delay, or uncertainty for the family.
